TERMS AND CONDITIONS

Definitions

“Account” means the personal user account created by You on the Website in order to participate in Draws.  

“Closing Date” means the closing date of a Draw as shown on the Website.

“Draw(s)” means any prize competition or free draw operated by Win Life Competitions Ltd.

“Entry” means a valid paid or free postal entry to a Draw.

“Free Entry” means a free postal entry submitted in accordance with the free postal entry instructions set out below.

“Prize” means the prize or prizes as specified on the Draw entry page of the Website.

“Website” means Win Life Competitions website at winlifecomps.co.uk 

“Winner(s)” means the winner of a Prize.

1. Introduction

1.1 These terms and conditions apply to your (“You”, “Your”) use of Website and to each Draw on this Website.

1.2 The Website and Draws are operated by Win Life Competitions Ltd trading as “Win Life Competitions”, (company number: SC868048) whose registered office is at 20-22 Wenlock Road, London, England, N1 7GU (“Win Life Competitions”, “Us”, “We” or “Our”).   

1.3  There is no requirement to pay to participate in our Draws as there is always a Free Entry route available as an alternative to paying to enter.  Free postal entries are treated in Draws in the same way as paid entries.  One paid Entry is equal to one postal Entry.  Purchasing an Entry to a Draw (as opposed to entering by post for free) does not increase Your chances of winning a Prize.     

1.4 We may change these terms and conditions at any time and will publish a revised version on the Website.  Please check the terms carefully, as they apply to any entries You make to Our Draws, whether paid or unpaid.

2. Entering a Draw

2.1 Draws are open only to UK residents only.  If You reside outside the UK, You must not enter our Draws.  

2.2 Our employees and those of companies in our corporate group as well as anyone directly connected with the operation of Our Draws may not enter.

2.3 You must be 18 years of age in order to enter our Draws.  We reserve the right to verify the age of all participants.  Any individual entering a Draw who is found to be under 18 will forfeit any Prize won and will have their Account closed.  

2.4 Each Draw is limited to the maximum number of free/paid entries per person stated on the relevant Draw page.

2.5 You must ensure that all information You provide us is correct including Your contact information.  You must tell us immediately if Your personal details change. 

2.6 Entries must be made via the Website or by post.  You must have an Account on the Website in order to enter our Draws either by paying or by post.  

2.7 We accept no responsibility for entries which are incomplete, delayed, damaged or not received by Us by the Closing Date for whatever reason.

2.8 Only the individual who is registered for an Account with Us can enter a Draw.  Entries submitted on behalf of other people or by automated means (e.g. bots), whether paid or by post are invalid and any Prize won will be forfeited.

2.9 Entries into a Draw will be confirmed by e-mail or will be shown in Your Account.  

3. Free Entry

3.1 In order to submit a Free Entry, You must first create an Account on the Website. Each Free Entry must be sent to us by sending a pre-paid first or second-class postcard to the following address: 

Win Life Competitions, PO Box 28971, Dalkeith, Scotland, EH22 9DH. 

3.2 The postcard must include:

● Your name, residential address, email address and contact telephone number;

● Your date of birth;

● the name of the Draw You wish to enter;

● confirmation that You agree to the Draw terms and conditions; and

● (if applicable:) the answer to the question.

3.3 You must ensure that the Free Entry is complete and clearly legible, and that the personal details exactly match those registered on Your online Account.

3.4 It is your responsibility to pay the correct postage (first or second class) and to send the Entry in good time, so that We receive it before the Closing Date. Provided that the Draw is not closed when We receive your Free Entry, we will enter it into the Draw and we will show Your name and ticket number on the entry list on Website after the Draw closes.

3.5 Any Free Entry received before the Closing Date (or before a Draw is closed early under clause 5.2) will be allocated an Entry number and included in the Draw in the same manner as a paid Entry.  A Free Entry has the same chance of winning as a paid Entry to a Draw.    

4. Subscriptions

4.1 If You subscribe for repeat purchases, we will automatically enter You with the same number of tickets into the next Draw for that subscription type in the following subscription period (e.g., calendar month/week as applicable).  There will be no refunds made after payment has been made.  You can adjust the number of tickets or cancel the subscription in the “Your Account” section of the Website at any time.  Example:  If You buy five tickets to a Draw on 3 April and also take out a monthly subscription for Draw, as well as entering You for the Draw, we will automatically take payment for five tickets for the May Draw on 1 May – unless you adjust the number of tickets or cancel your subscription before then. This payment will be requested on the first day of each calendar month until You cancel Your subscription.

4.2 You authorise Us and our payment provider to place a hold on, or charge, Your payment method for the relevant amounts or otherwise take payment whenever payments are due in accordance with this agreement.  It is Your responsibility to update your payment card details as necessary.

4.3 We may at any time change our subscription prices.  We will give you notice by email at least one month before any price change takes effect.  If You do not agree with the new price, you may cancel Your subscription. 

5. Closing a Draw

5.1 Draws will close on the Closing Date.

5.2 A Draw may be closed earlier than the Closing Date, if all of the tickets have been sold or allocated.

5.3 Where a Draw is closed early under clause 5.2, we will continue to process free postal entries received prior to the time and date of closure of the Draw.  

5.4 The Closing date of a Draw will not be extended unless there are exceptional circumstances (e.g. due to a payment processing or IT failure).

5.5 We reserve the right to cancel a Draw if, in our reasonable opinion, insufficient entries have been received.  In such a situation, all paid Entry Fees will be refunded or, where stated on the Draw page, a cash alternative may be offered.  

6. Draw

6.1 The Winner of a Draw will be chosen using a verifiably random selection process.  We will live-stream Draws on Facebook and/or YouTube and/or any other social media or other platform stated on the Website.

6.2 The odds of winning a Prize will depend on the total number of valid entries to that Draw.   

6.3 Draws will take place on the Closing Date.

6.3 In accordance with advertising regulations, we will publish the surname and county of Winners on the Website unless You object.  When You are notified by Us that You have won a Prize, You may withdraw Your consent to publication of Your personal details.  However, we will provide this information to the Advertising Standards Authority (ASA) on request.  

7. Notifying winners

7.1 We will notify Winners by email to the email address in Your Account. It is your responsibility to ensure that this information is correct.

7.2 Winners will have seven days from the date of our email to accept a Prize and to provide us with any proof of identity requested e.g. age, identity, purchase and/or bank details.  Such information must exactly match the details in Your Account.  If You cannot provide proof of your age or identity, the Prize will be forfeited.

7.3 We will not make any additional attempts to contact a Winner.  If the Prize is not accepted by a Winner and any proof of identity provided within the above timescale, we shall at our absolute discretion re-select a new Winner and the original Winner will forfeit the Prize.

8. Prizes

8.1 Prizes will be as specified on the Website.  We reserve the right to substitute a Prize with a similar Prize of equal value.

8.2 You acknowledge that there may be minor differences between actual Prizes and those shown on the Website.

8.3 Prizes are non-transferrable.

8.4 No cash alternatives are available, except where otherwise stated on the Draw page.

8.5 If a Winner is in breach of these terms and conditions, we shall be entitled (at our absolute discretion) to reselect a Winner and to award the Prize to an alternative person.  In this scenario, the original Winner will not be entitled to any Prize.  Please note in particular that entrants from outside the UK and those aged under 18 will not be awarded a Prize.  

8.6 Unless otherwise stated on the Website, We will arrange postage or delivery of Prizes excluding vehicles to the Winner’s residential address in the UK at our expense.  You may be required to provide proof of Your age and identity at the point of delivery of a Prize.  All risk passes to a Winner once a Prize has been delivered.  

8.7 For vehicles only:  Winners must collect vehicle Prizes from our office at their own expense within 30 days at a time agreed with Us.  All risk passes to a Winner once a vehicle Prize has been collected.  It is the Winner’s responsibility to ensure they are qualified to drive the vehicle and to arrange insurance, road duty etc from the point of collection.

8.8 If the Prize is a vehicle, it is the Winner’s responsibility to promptly follow the appropriate buyer procedures for transfer of ownership, including signing any ownership documents, as well as to insure the vehicle and to comply with all applicable laws and regulations.     

8.9 If You do not provide proof of Your age or identity at the point of delivery/collection or if the prize is undelivered for any reason after at least two delivery attempts or if You are required to collect a Prize from our office but don’t do so within the period stated above, We shall (at our absolute discretion) cancel the award of the Prize and award it to an alternative Winner.

8.10 Prizes are provided “as is” and without any warranty, undertaking or promise from Us as their quality, condition, value, suitability.  We do not insure Prizes and all risk passes to Winners on delivery or collection.

8.11 Prizes are subject to any terms and conditions of the manufacturer or supplier of the Prize.  

8.12 Winners are responsible for paying any taxes or duties payable in relation to their receipt of a Prize.

8.13 If the Prize is a holiday, you are responsible for passports, visas and other travel documents as well as travel insurance.

9. Player Welfare

9.1 We encourage responsible participation in all Draws. Our Draws are designed to be fun and engaging, and we do not encourage excessive or compulsive gambling behaviour.

9.2 If you feel that Your participation is becoming problematic or if You are concerned about someone else’s activity on our platform, we encourage You to seek support from an appropriate organisation such as GambleAware (www.gambleaware.org) or contact us directly to discuss your concerns.

9.3 We will close Your Account with Us on request to support@winlifecomps.co.uk and will take steps to prevent You from re-registering for an Account.  However, You must agree not to use alternative personal details (e.g. by changing Your name, address, e-mail address or mobile number) in order to re-register for an Account with Us.    

 10. Our rights

10.1 In all matters arising in connection with Draws, our decision shall be final and no correspondence will be entered into.

10.2 We reserve the right, acting reasonably and in accordance with these terms, to reject or exclude Your Draw Entry, cancel your Prize, close or delete Your Account (including all content in it) and/or permanently ban You from entering future Draws.  For example, we may close Your Account and You will forfeit a Prize if You owe us any money (including chargebacks) or if You haven’t complied with these terms and conditions or any applicable Draw rules or You have behaved abusively or inappropriately towards Us or others (including on social media) or You have cheated or attempted to cheat in any Draw.

10.3 Where a Draw is cancelled due to exceptional circumstances, we will fully refund all entries via the same method used to pay.

10.4 If a payment for an Entry to a Draw is reversed, charged back or otherwise cancelled after submission, the corresponding Entry will be deemed invalid and any Prize awarded in respect of that Entry may (at our absolute discretion) be forfeited.

11. Discount code misuse

11.1 Discount codes are provided for promotional purposes and must be used in accordance with the stated terms of the offer.  Unless explicitly stated, each discount code may only be used once per customer and may not be transferred.

11.2 For example, You must not use a discount code more than the permitted number of times or attempt to gain additional entries to a Draw by creating multiple accounts or altering personal details.

12. Things you can’t do on our Website

12.1 You agree not to do any of the following in connection with the Website:

● break the law or infringe anyone else’s rights;

● send, store, display or link to unlawful, infringing or otherwise inappropriate content;

● victimise or harass other people;

● use offensive, obscene, abusive, discriminatory or other inappropriate language or images;

● deceive or mislead anyone;

● provide any information that includes someone else’s personal information unless that person is 18 years or over and you have obtained their written consent or you are otherwise legally permitted to do so;

● impersonate anyone;

● use the Website with a view to competing with us or infringing our rights;

● use Our service for any commercial purpose;

● disrupt Our website, e.g. spam, viruses or phishing;

● interfere with or damage the Website or gain unauthorised access to any part of our system, data, passwords or otherwise;

● intercept or modify communications;

● impose an unreasonable load on the Website;

● get around any security features including those designed to stop copying of content; or

● attempt, encourage or assist any of the above.

13. Content on our site

13.1 If you provide content, you are responsible for it.  You agree that you have (and will

keep) all rights needed to enable us to use it in accordance with these terms and conditions.

13.2 If you post a review, rating or comment, You promise that it is your independent, honest, genuine opinion.

13.3 You acknowledge that any information published or sent on or via our site by other users is the sole responsibility of the person from whom such content originated and we are not responsible for it.

13.4 We do not guarantee that any guidance or similar information that we may make available on the Website is accurate or up to date.  You rely on it at your own risk.

13.5 We are allowed (without telling you) to reject, suspend, alter, remove or delete content for any reason and to disclose to the police or other relevant authorities or to a complainant any content or behaviour provided we are legally permitted to do so.

14. Other peoples’ services/advertising/websites

14.1 We may display other peoples’ services, advertising and/or links to other websites. We do not recommend or endorse, nor are we legally responsible for, any of these.  You use them at your own risk.

14.2 You agree that you are legally bound by the terms and conditions of any payment providers whose services you use on our Website.  

15. Your Account

15.1 Your Account on Our Website is for your personal use only. You must not create/use more than one Account on our site, for example by using a different email address, name or residential address.  You must not allow anyone else to use Your Account.  You agree to take reasonable care to keep Your login information confidential and to tell us immediately of any apparent breach of security, such as loss or misuse of a password.  You are responsible for other people who use Your Account or identity (unless and to the extent that we are at fault).

15.2 We reserve the right to disqualify any person who we reasonably suspect of collusion, bulk entry schemes, identity manipulation, use of third-party payment methods or other activity intended to circumvent these terms.  

15.2 We are entitled to close/delete Your Account if it has been inactive for at least 12 months.

16. Ending this contract

16.1 You can terminate your contract with us at any time by emailing us at support@winlifecomps.co.uk.  Ending the contract does not entitle You to a refund of any payments made to enter any of Our Draws.

16.2 We can terminate Our contract with You at any time by closing/deleting Your Account.

17. Liability – restrictions on our legal responsibility (IMPORTANT)

17.1 Nothing in this agreement in any way limits or excludes Our liability for negligence causing death or personal injury or for fraud or fraudulent misrepresentation or for anything which may not legally be excluded or limited.  In this section, any reference to us includes our employees and agents.

17.2 We are not liable for any loss or damage where:

● there is no breach of a legal duty owed to you by Us;

● such loss or damage was not reasonably foreseeable (meaning it was not an obvious consequence of our breach or not contemplated by You and Us at the time We entered into this contract);

● (and to the extent that) such loss or damage is your fault; or

● such loss or damage relates to a business of Yours.

17.3 You will be responsible to us for any reasonably foreseeable loss or damage We suffer (including claims made by other people) resulting from your breach of this agreement or these terms.

17.4 Subject to clause 17.1, Our total aggregate liability to You in connection with any Draw shall not exceed the greater of (a) the total Entry Fees paid by You in the preceding 12 months; or (b) £1,000.  

18. Intellectual property rights

18.1 The intellectual property rights in all material used on or in connection with Our Website are owned by us or our suppliers, partners or other users.  For your personal use only, you may view such material on your device.  You must not otherwise use such material including copying, publishing, selling or altering it or taking extracts from it without our specific prior written consent.

18.2 You must not collect, scrape, harvest, frame or deep-link to any information on Our Website without our specific prior written consent.

19. If the Website doesn’t work properly

19.1 We do not guarantee that Our Website will be uninterrupted or error-free. We are entitled, without notice and without liability (a) to suspend the Website for repair, maintenance, improvement or other technical reason and (b) to make changes to the Website.

20. Things we can’t control

20.1 We are not liable for failure to perform or delay in performing any obligation under this agreement if the failure or delay is caused by any circumstances beyond our reasonable control including third party telecommunication failures and epidemics/pandemics.

21. Anti Money Laundering Policy

21.1 We have implemented measures to prevent our systems from being used for the purposes of money laundering, terrorist financing or any other criminal activity.

21.2 We are committed to preventing money laundering and combatting the financing of terrorism in order to minimise and manage our reputational risk, legal risk and regulatory risk.  We are also committed to its wider social responsibility in preventing crime by not allowing Our systems to be used to commit crimes.

21.3 In order to adhere to Anti Money Laundering regulations and requirements, we shall:

● appoint a designated Money Laundering Reporting Officer (MLRO) whose responsibility it is to report possible acts of money laundering to the authorities (the MLRO is Peter Toye);

● take reasonable steps to establish the identity of any person for whom we propose to provide our service;

● keep at all times a secure online list of all registered users.

● retain identification and transactional documentation for each user;

● provide initial and ongoing training to all relevant staff so that they are aware of their personal responsibilities and procedures in respect of identifying users, monitoring user activity, record-keeping and reporting any unusual/suspicious transactions;

● ensure that this policy is reviewed and maintained regularly;

● examine, as much as is possible, the background and purpose of any complex or large transactions or groups of transactions which are likely, by their nature, to be related to money laundering or the funding of terrorism;

● not accept or open anonymous accounts or accounts in fictitious names such that the true beneficial owner is not known;

● not register a player who is under eighteen (18) years of age;

● only register a single Account in the name of a particular person;

● transfer payments of winnings or refunds back to the same route from where the funds originated, where possible;

● not accept cash from players and only received funds from users by any of the approved methods;

● terminate a user’s registration if We become aware that a person has provided false information to Us;

● report any suspicion or knowledge of money laundering of terrorism financing to the authorities; and

● cooperate with all relevant administrative, enforcement and judicial authorities in their endeavour to prevent and detect criminal activity.

22. Your personal information – see our privacy policy

22.1 You agree that we can deal with your personal information in accordance with our Privacy Policy which may change from time to time.

23. English law and courts

23.1 Nothing in this clause affects Your statutory rights as a consumer.  

23.2 These terms and conditions are covered by English law and any disputes will be decided only by the courts of England.  You accept and agree to the exclusive jurisdiction of the courts of England when entering Our Draws.  

24. General but important information

24.1 We may send all notices under this agreement by email to the most recent email address You have given us.  You can send notices to our email address shown below.  Headings used in this agreement are for information and are not binding.  If any part of this agreement is ineffective or unenforceable for any reason, the rest of the agreement shall still be valid.  If either of us overlooks any breach of this agreement by the other, this does not prevent its enforcement.  We may transfer this agreement to someone else but this will not affect Your rights or obligations.  A person who is not a party to this agreement can’t enforce it, unless the agreement says otherwise.
